These terms govern your use of the Serenity Fort Hotel website and any booking or enquiry you make through it. By using the site or sending us a booking request, you agree to these terms. Please read them carefully.

1. Scope & acceptance

These Terms of Use (the “Terms”) apply to the website at serenityforthotel.co.ke (the “Site”) operated by Serenity Fort Hotel & Conferencing Ltd (the “Hotel”, “we”, “our”) and to any booking, reservation, or enquiry you make through it.

By accessing the Site or by submitting a booking request, you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy and Cookies Policy. If you do not agree, please do not use the Site.

2. About Serenity Fort

Serenity Fort Hotel & Conferencing Ltd operates a hotel, restaurants, conference hall, and outdoor meeting facilities in Mariakani, Kilifi County, Kenya, under the trading name “Serenity Fort”. The legal entity registered in Kenya under certificate of incorporation is responsible for all bookings made through this Site.

3. Use of the website

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use of the Site. In particular, you agree not to:

  • Use the Site in any way that breaches any applicable local, national, or international law or regulation.
  • Use the Site to transmit any unsolicited or unauthorised advertising, promotional material, or similar communications (spam).
  • Use the Site to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
  • Attempt to gain unauthorised access to any part of the Site or any server, computer, or database connected to the Site.
  • Attack the Site via a denial-of-service attack or a distributed denial-of-service attack.

4. Bookings & enquiries

Enquiries and booking requests made through the contact form on this Site are subject to confirmation by the Hotel. Submission of a request does not constitute a confirmed booking — we will send you a written confirmation by email or phone once availability is verified and any deposit is received.

You must be at least 18 years old to make a booking. When booking on behalf of others (a group, a family, a company), you confirm that you have the authority to do so and to accept these Terms on their behalf.

Please ensure that the details you provide are accurate. We are not responsible for bookings that cannot be honoured due to incorrect or incomplete information.

5. Rates & payments

Rates published on the Site are quoted in Kenyan Shillings (KES) per person, per night, and exclude meals unless stated. Rates are subject to change without notice until a booking is confirmed by the Hotel in writing.

Payment terms, deposit requirements, and accepted methods of payment will be communicated in the booking confirmation. Until the deposit (if any) is received, the booking remains provisional.

Quoted rates “from” figure. The starting rate on the Site reflects our Standard room on a board-only basis. Actual price depends on room category, dates, meal plan, and number of guests. The full rate is confirmed in your booking confirmation.

6. Cancellations & refunds

Our standard cancellation policy applies unless otherwise stated in your booking confirmation:

  • Cancellations made more than 14 days before arrival: full refund of any deposit paid.
  • Cancellations made 7–14 days before arrival: 50% refund of any deposit paid.
  • Cancellations made fewer than 7 days before arrival, or no-shows: no refund.

For event and conference bookings, the cancellation policy set out in your event contract applies. Refunds, where due, are processed within 14 business days to the original payment method.

7. Check-in & check-out

Standard check-in is from 14:00 on the day of arrival and check-out is by 11:00 on the day of departure. Early check-in and late check-out may be available on request, subject to availability, and may incur an additional charge.

On check-in, you will be asked to present a valid photo identification (passport, national ID, or driving licence) and to provide a credit or debit card or cash deposit for incidentals.

8. Guest obligations

As a guest of the Hotel, you agree to:

  • Conduct yourself in a manner that respects other guests, staff, and the property.
  • Comply with all reasonable instructions from Hotel staff, including those relating to fire safety, security, and use of facilities.
  • Pay for any damage caused to the room or property during your stay.
  • Not smoke in any non-designated area. Smoking is permitted only in designated outdoor areas.
  • Not bring any animal onto the property other than registered service animals.

9. Events & conference bookings

For conferences, weddings, retreats, and other event bookings, a separate event contract is signed between the Hotel and the event organiser. The event contract takes precedence over these Terms in case of conflict on event-specific matters (deposits, layouts, catering, parking, external suppliers, and so on).

10. Liability

The Hotel maintains appropriate insurance coverage for guest safety and property. We are not liable for:

  • Any loss, damage, or theft of personal belongings left in rooms, vehicles, or public areas, except where caused by our negligence.
  • Any indirect, consequential, or punitive losses arising from your use of the Site or stay at the Hotel.
  • Any failure or delay in performance caused by events outside our reasonable control (force majeure), including but not limited to extreme weather, power outages, government action, epidemics, or industrial action.

Nothing in these Terms limits any liability that cannot be excluded or limited under Kenyan law.

11. Intellectual property

All content on this Site — including text, graphics, logos, icons, images, photographs, and software — is the property of Serenity Fort Hotel & Conferencing Ltd or its licensors and is protected by Kenyan and international copyright laws.

You may view, download, and print pages from the Site for your personal, non-commercial use, provided you keep all copyright and other proprietary notices intact. Any other use requires our prior written permission.

12. Third-party links

The Site may contain links to third-party websites for your convenience (social media, mapping services, partner operators). We do not control and are not responsible for the content or practices of those websites, and the inclusion of a link does not imply endorsement.

13. Changes to these terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or the services we offer. The updated version will be posted on this page with a revised “Effective” date. Material changes that affect existing bookings will be communicated directly to affected guests.

14. Governing law & disputes

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or in connection with these Terms — including any dispute regarding their existence or validity — shall be subject to the exclusive jurisdiction of the courts of Kenya, sitting in Mombasa, unless mandatory consumer protection law provides otherwise.

Before initiating formal proceedings, we encourage you to contact us directly so we can attempt to resolve the matter amicably. You may also refer the matter to the Kenya Tourist Board, the Tourism Regulatory Authority, or the Office of the Data Protection Commissioner, where applicable.
